Whole Foods Workers Unite

In a victory hailed as a milestone for retail workers across the cWhole Foods protestountry, workers at the Madison,Wisconsin Whole Foods voted to unionize in July 2002. Organizing around issues of respect, fair compensatio n, and a call for Whole Foods to live up to its own values, a small group of workers, committed to worker control and rank and file democracy, led and carried out the campaign. Although workers fought for card-check recognition, the company refused to recognize their union and forced them to go through an NLRB election. Despitea hostile anti-union campaign carried out by the company, workers voted 65-54 in favor of union representation, affiliating with the United Food and Commercial Workers (UFCW) Local 1444.

The workers’ victory was both a surprise and a major blow to a company that has made no secret of its hatred of unions. “Here's the way I like to think of it,” founder and CEO John Mackey once said. “The union is like having herpes. It doesn't kill you, but it’s unpleasant and inconvenient and it stops a lot of people from becoming your lover" (Business and Society Review, 6/22/92).

I want to suggest that instead of walking to Personnel alone we join together and walk the streets of Detroit with Delphi workers. A demonstration is planned for the Auto Show in January. All the auto industry executives from around the world will be in town. Thousands of journalists will be there.

If enough of us take to the streets of Detroit the world will get the message that we’ve had enough. Delphi wants to shut plants in all the high wage countries �" here, England, Japan, Sweden, Germany �" and move our work to low wage places.

Clinton Jencks, 87; Organizer Who Led Mineworkers Strike Later Taught at San Diego State

Union organizer Clinton Jencks, who led New Mexico mineworkers in a McCarthy-era strike chronicled in the classic 1953 motion picture "Salt of the Earth," has died. He was 87.

Jencks died Dec. 14 in San Diego of natural causes, according to his daughter, Linda O'Connell.

An organizer for a progressive union, Jencks led a 15-month strike begun in 1950 near Bayard, N.M., against Empire Zinc Co. by the Amalgamated Bayard District Union of Mine, Mill and Smelter Workers Local 890. The largely Latino strikers sought pay equal to that of white workers, improved safety conditions and healthcare — goals they eventually won with great effort.

When company officials obtained an injunction barring the men from picketing, their wives and children took their place. Arrested and jailed, the families made such a noisy clatter in the jail that a harried sheriff let them go.

Hollywood could not ignore such drama, and blacklisted producer Paul Jarrico, director Herbert Biberman and screenwriter Michael Wilson decided to make a movie about the conflict.

Because of the anti-Communist scare gripping Hollywood, the filmmakers had no financial backing and little professional help. They hired blacklisted actor Will Geer and Mexican actress Rosaura Revueltas, who was deported for her participation.

Otherwise, they had the Mexican American mineworkers and their families portray themselves. Jencks, a tall blond man called "El Palomino" by the Latinos, played Frank Barnes, a character based on him, and Jencks' first wife, Virginia, played Barnes' spouse, Ruth.

The movie is one of 400 selected by the Library of Congress for the National Film Registry, and film historian Leonard Maltin's Classic Movie Guide says: "This film is particularly impressive considering its history — made under difficult conditions (and on a shoestring), with many nonprofessional actors, by blacklisted filmmakers."

When the movie came out, it was certainly no box office success.

Under McCarthyism pressure from the House Committee on Un-American Activities, the Screen Actors Guild and the International Alliance of Theater and Stage Employees — not to mention a boycott led by Howard Hughes — the film was shut out of all but 13 theaters across the country.

Jencks, along with Revueltas and the filmmakers, suffered for the project. The labor organizer was convicted of perjury in El Paso in 1954 and sentenced to five years in prison. The charge stemmed from a requirement under the Taft-Hartley Act that union officials sign an affidavit swearing they were not members of the Communist Party — a document Jencks had signed in 1950.

Jencks said he signed the affidavit truthfully, but the federal government accused him of lying. It was relying on testimony by Henry Matusow, an aide to Sen. Joseph McCarthy (R-Wis.). Matusow, who subsequently wrote the book "False Witness," later recanted his testimony, but the Texas judge ignored his turnabout.

In 1957, however, the U.S. Supreme Court overturned Jencks' conviction in a landmark opinion that established the right of criminal defendants to obtain prior statements made to authorities by witnesses against them. The government opted not to retry Jencks rather than open its FBI files containing Matusow's statements.

Despite the court victory, Jencks was dogged by rumors of association with Communists and had trouble getting or keeping jobs.

He was working as a mechanic in Albany, Calif., in 1959 when the conservative Woodrow Wilson Foundation awarded him a graduate fellowship to UC Berkeley. The foundation said it had found no evidence that Jencks was then or had ever been a Communist.

After earning a doctorate in economics, Jencks taught at San Diego State from 1964 until his retirement in 1988.

A native of Colorado Springs, Colo., he served in the Army Air Forces in the Pacific Theater throughout World War II. He later worked in a smelter near Denver, before he was sent to southern New Mexico as an organizer for the International Union of Mine, Mill and Smelter Workers.

In addition to his daughter, Jencks is survived by his second wife, Muriel; three stepdaughters; and three grandchildren. His son, Clinton, died in 1995.

Critics of Wikipedia sometimes act as though Wikipedia started as a giant, powerful information resource, which imposed these crazy anarchic practices on us.

But, of course, it started as a place for these crazy anarchic practices, and happened to grow into a giant, powerful information resource.

That's the striking result. Which seems to demand a response. Either we celebrate that it seems like giving people freedom can produce something that's not at all bad. And often surprisingly good.


Or we can go "conservative" and decide that the result is so dangerous that it turns out people shouldn't be given freedom to speak out and write in public. And that Wikipedia as it is, should somehow be closed down or otherwise changed into a moderated site?


There is a third response : to try to compete with wikipedia with an alternative, gated by experts.


But I'm not sure what other "solutions" people could be asking for?

Too tired and overworked myself to write an adequate and coherent commentary on the NYC transit strike, but at least I have the energy to quote somebody else. Once in a while, I really do have to agree with the Trotskyists of the World Socialist Web Site, who are actually providing the best coverage of the topic that I can find right now. I’m going to quote my favorite paragraphs from the article The New York transit strike: A new stage in the class struggle (although I think the title overrates it somewhat – though this is pretty good as labor union strikes go these days). Of course, I have stopped the quote just short of the suggestion that we all help to build the Socialist Equality Party. I’m not so sure about that…but I like this:

The workers are in a powerful position. The MTA and the ruling establishment are unable to replace 34,000 workers and run the huge transit system with scab labor, as was done against the PATCO air traffic controllers. It cannot outsource public transportation or shift it to a low-wage haven. And the cost of the walkout to the city’s businesses is estimated in the hundreds of millions of dollars daily. The frenzied ultimatums and threats cannot conceal the weakness of the city’s and state’s position.

Governor Gropengrabber's hometown in Austria, Graz, was threatening to remove Ahnuld's name from the local soccer stadium because he approved the execution of Tookie Williams. Reacting like the calm, rational adult we all know him to be, Ahnuld insisted that they take his name off the stadium by the end of the year. Also, he revoked permission to use his name to promote the town. And he sent back a "ring of honor" they gave him in 1999.

The Library contains research papers, reports, news and features from both local and international sources.

The aim of the Library is to organize information about Conflict Transformation & Peacebuilding information online in a manner that makes it easily accessible and useful. Apart from electronic documents and multimedia content,the Library will soon make available indexes of important brick-and-mortar library resources from several key peacebuilding organizations in Sri Lanka.

Indexes are compiled manually by our research department to maintain relevance and accuracy. The content available via the Peace Library will be updated regularly and new features will be added to the platform in an ongoing basis.

The North American International Auto Show is a much needed bright spot for Metro Detroit. It's the opportunity for Detroit to show off for the national media, to brag a little about its products and its people.

Charity preview night is to Detroit what the Oscars ceremony is to Los Angeles.

But this year, it seems everyone with a grievance is making plans to bring their picket signs to Cobo Center to air their protests before the show's expected 1 million visitors.

United Auto Workers' groups from both Delphi Corp. and General Motors Corp. are threatening to picket the charity preview and the media and public show days. And even some disgruntled public radio listeners say they'll be in front of Cobo to protest changes in programming at WDET.

This is pointless. People go o the auto show for a feel-good experience, to get excited about a vast expanse of new cars and trucks. Michigan surely needs folks to feel that excitement.

There are better venues for the protesters. The UAW workers can take their signs and their shouts to the corporate headquarters, where the people making the decisions about their fate may actually hear them.

As for the radio listeners -- why not picket the radio station? Or better yet, why not simply choose a different channel, or take advantage of the unlimited offerings of satellite radio? Their demonstration seems rather silly.

The auto show should not become a magnet for malcontents. This year, particularly, it's important that visitors to the show come away with some sense of optimism about the future of this town and this industry.

Making them wade through picket signs will detract from that goal.

Junemann says more unions need to be like trade unions and provide skills training, apprenticeships and lifelong learning. By doing that, he sees unions appealing to independent contractors and groups of professional workers at small- and medium-sized businesses. He says more employers would be willing to work with unions to meet their work force needs.

Sometimes it strikes me just how lame activism has become. A one-time event by a group of EMU social work students made the paper today for feeding a free hot meal to forty people in Ypsi. The article makes sure to note corporate donors Zoup and Starbucks for their donations. This is all praiseworthy, and nice to see happen.

However.

I'm reading the news in a break between sections of writing - the piece I just finished is about the Black Panthers' programs, which fed free breakfasts to thousands of Oakland schoolchildren daily for years, and occasional distributions of 10,000 bags of groceries. I'm kinda betting that this event in Ypsi had no political message attached to it, no, "So, why are these people hungry, anyways?" Or, at least, no such message well-stated enough and integral enough to the event to make the news.

But, hey. I've never organized an event to feed forty people once, so I have to look favorably on those who have, even if I have enough context to know how little good it's doing.

Folks, the piggy bank is being raided - has been raided for years. We sort of know that Halliburton is getting special favors, cops looking the other way while it bilks us - the US taxpayers. It's gotten more blatant with the super-duper sweetheart contracts and special suspensions of laws since Hurricane Katrina, but really, it's just business as usual for this administration.

Miller said he is glad that Gordon Hall, a Greek Revival mansion built in the 1840s, will be preserved, rather than demolished to make room for a housing or commercial development on 67 acres of choice land.

So far, he has made 28 walking sticks of oak from his own farm, with curved handles adorned with the Gordon Hall walnut pieces. He donated eight of them to the Dexter Area Historical Society, which has successfully bid to buy the property from U-M for $1.5 million. The local historical group is raising the money to close the deal early next year.

WCBS-TV: Toussaint, TWU International About To Butt Heads?
Dec. 20-Toussaint and the Local 100 of the Transport Workers Union may soon find themselves fighting a battle on two fronts. That is, as long as they continue to strike despite the negative endorsement from their parent organization, TWU International.

Dec. 20 - With a one billion dollar surplus, a contract between the MTA and Transport Workers Union Local 100 should have been a no brainer. Sadly, that has not been the case.

Our contract expired on midnight Thursday. In an attempt to save mass transit and in deference to our riders, we postponed our deadline and attempted to continue talking to the MTA.

That’s the thing about Ilitch - he restored the Fox Theater and did a beautiful job, but he owns many other old buildings in the area that he’s left abandoned for years, allowing them to rot, including the Fine Arts Building, the Adams theater, the United Artists Building, the Madison-Lenox Hotel (recently demolished after years of neglect), the Detroit Building, the Hotel Vermont and the Blenheim Apartments. That number pretty much outweighs his renovation of the Fox Theater. In fact, Ilitch owns more vacant buildings in the city than any other entity except the City itself.

"Sometimes when you collaborate, you have to trust people more than you have any reason to do so," he said. "It works because most people are good."

Over at CJR, Bryan Keefer offers a defense of Wikipedia. After weeks of controversy over its erroneous John Seigenthaler entry last month, Keefer says it’s all been overblown and the open-source encyclopedia has been a victim of a "schadenfreude"-driven MSM campaign. Keefer says Wiki represents the future:

“Part of the argument against Wikipedia rests on the idea that users aren't able to assess the credibility of the information they're reading. In truth, however, Internet users are getting smarter about figuring out whether to believe information they find online (or, for that matter, in major news outlets). Google is a big part of this trend. The search engine produces results based on how many sites link to a given page; the more links to a page, the higher the result. Those links are generated by human beings, who are presumably doing so because they think the information they're linking to is credible (or, at the very least, interesting).

Try dropping ‘Swiffer Wetjet’ into Google, for example. A rumor last year had it that the product, a floor cleaning system, was harmful to household pets. But the first Google results are pages debunking the myth, not propagating it. In other words, the more credible information has risen to the top.”

So the value of Wikipedia, and the Internet, is that the truth will rise to the top, eventually? I wonder, would Mr. Seigenthaler agree? And in spite of company assurance, how can you really be sure your "Swiffer Wetjet" isn't hurting Fluffy? Because Google says so?

INDIANAPOLIS — Gov. Mitch Daniels said yesterday that the state failed in its bid to keep the Colgate-Palmolive Co. toothpaste factory in Indiana because it doesn't have right-to-work legislation.

The Army National Guard, battling a falloff in recruiting, is offering troops a finder's fee for lining up new soldiers. The Guard Recruiter Assistant Program, launched this week in five states, offers National Guard members $1,000 for enlisting a recruit and another $1,000 when the prospect shows up for basic training. “Bring in 10 people and you can earn $20,000,” says Lt. Col. Mike Jones, deputy division chief for recruiting and retention at the National Guard Bureau.

On the Fine Art of Listening

I want to write about the great and powerful things that listening is. And how we forget it. And how we don't listen to our children, or those we love. And least of all - which is so important too - to those we do not love. But we should. Because listening is a magnetic and strange thing, a creative force. Think how the friends that really listen to us are the ones we move toward, and we want to sit in their radius as though it did us good, like ultraviolet rays.

This is the reason: When we are listened to, it creates us, makes us unfold and expand. Ideas actually begin to grow within us and come to life. You know how if a person laughs at your jokes you become funnier, and if he does not, every tiny little joke in you weakens up and dies. Well, that is the principle of it. It makes people happy and free when they are listened to. And if you are a listener, it is the secret of having a good time in society (because everybody around you becomes lively and interesting), of comforting people, of doing them good.

Who are the people, for example, to whom you go for advice? Not to the hard, practical ones who can tell you exactly what to do, but to the listeners: that is, the kindest, least censorious, least bossy people that you know. It is because pouring out your problem to them, you then know what to do about it yourself.

When we listen to people there is an alternating current, and this recharges us so that we never get tired of each other. We are constantly being re-created. Now there are brilliant people who cannot listen much. They have no ingoing wires on their apparatus. They are entertaining, but exhausting, too. I think it is because these lecturers, these brilliant performers, by not giving us a chance to talk, do not let us express our thoughts and expand; and it is this little creative fountain inside us that begins to spring and cast up new thoughts and unexpected laughter and wisdom. That is why, when someone has listened to you, you go home rested and lighthearted.

Now this little creative fountain is in us all. It is the spirit, or the intelligence, or the imagination - whatever you want to call it. If you are very tired, strained, have no solitude, run too many errands, talk to too many people, drink too many cocktails, this little fountain is muddied over and covered with a lot of debris. The result is you stop living from the center, the creative fountain, and you live from the periphery, from externals. That is, you go along on mere will power without imagination.

It is when people really listen to us, with quiet fascinated attention, that the little fountain begins to work again, to accelerate in the most surprising way.

I discovered all this about three years ago, and truly it made a revolutionary change in my life. Before that, when I went to a party I would think anxiously: "Now try hard. Be lively. Say bright things. Talk. Don't let down." And when tired, I would drink a lot of coffee to keep this up.

Now before going to a party, I just tell myself to listen with affection to anyone who talks to me, _to be in their shoes when they talk_; to try to know them without my mind pressing against theirs, or arguing, or changing the subject. No. My attitude is: "Tell me more. This person is showing me his soul. It is a little dry and meager and full of grinding talk just now, but presently he will begin to think, not just automatically to talk. He will show his true self. Then hew will be wonderfully alive."

Sometimes, of course, I cannot listen as well as others. But when I have this listening power, people crowd around and their heads keep turning to me as though irresistibly pulled. It is not because people are conceited and want to show off that people are drawn to me, the listener. It is because by listening I have started up their creative fountain. I do them good.

Now why does it do them good? I have a kind of mystical notion about this. I think it is only by expressing all that is inside that purer and purer streams come. It is so in writing. You are taught in school to put down on paper only bright things. Wrong. Pour out the dull things on paper too - you can tear them up afterward - for only then do the bright ones come. If you hold back the dull things, you are certain to hold back what is clear and beautiful and true and lively.

So it is with people who have not been listened to in the right way - with affection and a kind of jolly excitement. Their creative fountain has been blocked. Only superficial talk comes out - what is prissy or gushing or merely nervous. No one has called out of them, by wonderful listening, what is true and alive.

I think women have this listening facility more than men. It is not the fault of men. They lose it because of their long habit of striving in business, of self-assertion. And the more forceful men are, the less they can listen as they grow older. And that is why women in general are more fun than men, more restful and inspiriting.

Now this non-listening of able men is the cause of one of the saddest things in the world - the loneliness of fathers, of those quietly sad men who move among their grown children like remote ghosts. When my father was over 70, he was a fiery, humorous, admirable man, a scholar, a man of great force. But he was deep in the loneliness of old age and another generation. He was so fond of me. But he could not hear me - not one word I said, really. I was just an audience. I would walk around the lake with him on a beautiful afternoon and he would talk to me about Darwin and Huxley and Higher Criticism of the Bible.

"Yes, I see, I see," I kept saying and tried to keep pinned to it, but I was restive and bored. There was a feeling of helplessness because he could not hear what I had to say about it. When I spoke I found myself shouting, as one does to a foreigner, and in a kind of despair that he would not hear me. After the walk I would feel that I had worked off my duty and I was anxious to get him settled in his Morris chair, so that I could go out and have a livelier time with other people. And he would sigh and look after me absentmindedly with perplexed loneliness.

For years afterward I have thought with real suffering about my father's loneliness. Such a wonderful man, and reaching out to me and wanting to know me! But he could not. He could not listen. But now I think that if only I had known as much about listening as I do now, I could have bridged that chasm between us. To give an example:

Recently, a man I had not seen for 20 years wrote me: "I have a family of mature children. So did your father. They never saw him. Not in the days he was alive. Not in the days he was the deep and admirable man we now both now he was. That is man's life. When next you see me, you'll know just everything. Just your father all over again, trying to reach through, back to the world of those he loves."

Well, when I saw this man again, what had happened to him after 20 years? He was an unusually forceful man and had made a great deal of money. But he had lost his ability to listen. He talked rapidly and told wonderful stories and it was just fascinating to hear them. But when I spoke - restlessness: "Just hand me that, will you? ... Where is my pipe?" It was just habit. He read countless books and was eager to take in ideas, but he just could not listen to people.

Well, this is what I did/ I was more patient - I did not resist his non-listening talk as I did my father's. I listened and listened to him, not once pressing against him, even in thought, with my own self-assertion. I said to myself: "He has been under driving pressure for years. His family has grown to resist his talk. But now, by listening, I will pull it all out of him. He must talk freely and on and on. When he has been really listened to enough, he will grow tranquil. He will begin to want to hear me."

And he did, after a few days. he began asking me questions. And presently I was saying gently:
"You see, it has become hard for you to listen."

He stopped dead and stared at me. And it was because I had listened with such complete, absorbed, uncritical sympathy, without one flaw of boredom or impatience, that he now believed and trusted me, although he did not know this.

"Now talk," he said. "Tell me about that. tell me all about that."

Well, we walked back and forth across the lawn and I told him my ideas about it.

"You love your children, but probably don't let them in. Unless you listen, people are wizened in your presence, they become about a third of themselves. Unless you listen, you can't know anybody. Oh, you will know facts and what is in newspapers and all of history perhaps, but you will not know one single person. You know, I have come to think listening is love, that's what it really is."

Well, I don't think I would have written this article if my notions had not had such an extraordinary effect on this man. For he says they have changed his whole life. He wrote me that his children at once came closer; he was astonished to see what they are: how original, independent, courageous. His wife seemed really to care about him again, and they were actually talking about all kinds of things and making each other laugh.

For just as the tragedy of parents and children is not listening, so it is of husbands and wives. If they disagree they begin to shout louder and louder - if not actually, at least inwardly - hanging fiercely and deafly onto their own ideas, instead of listening and becoming quieter and quieter and more comprehending. But the most serious result of not listening is that worst thing in the world, boredom; for it is really the death of love. It seals people off from each other more than any other thing. I think that is why married people quarrel. It is to cut through the non-conduction and boredom. Because when feelings are hurt, they really begin to listen. At last their talk is a real exchange. But of course, they are just injuring their marriage forever.

Besides critical listening, there is another kind that is no good: passive, censorious listening. Sometimes husbands can be this kind of listener, a kind of ungenerous eavesdropper who mentally (or aloud) keeps saying as you talk: "Bunk...Bunk...Hokum."

Now, how to listen? It is harder than you think. I don't believe in critical listening, for that only puts a person in a straitjacket of hesitancy. He begins to choose his words solemnly or primly. His little inner fountain cannot spring. Critical listeners dry you up.

But creative listeners are those who want you to be recklessly yourself, even at your very worst, even vituperative, bad-tempered. They are laughing and just delighted with any manifestation of yourself, bad or good. For true listeners know that if you are bad-tempered it does not mean that you are always so. They don't love you just when you are nice; they love all of you.

In order to learn to listen, here are some suggestions: Try to learn tranquility, to live in the present a part of the time every day. Sometimes say to yourself: "Now. What is happening now? This friend is talking. I am quiet. There is endless time. I hear it, every word." Then suddenly you begin to hear not only what people are saying, but what they are trying to say, and you sense the whole truth about them. And you sense existence, not piecemeal, not this object and that, but as a translucent whole.

Then watch your self-assertiveness. And give it up. try not to drink too many cocktails to give up that nervous pressure that feels like energy and wit but may be neither. And remember that it is not enough just to _will_ to listen to people. One must _really_ listen. Only then does the magic begin.

Sometimes people cannot listen because they think that unless they are talking, they are socially of no account. There are those women of an old-fashioned ballroom training that insists there must be unceasing vivacity and gyrations of talk. But this is really a strain on people.

No. We should all know this: that listening, not talking, is the gifted and great role, and the imaginative role. And the true listener is much more beloved, magnetic than the talker, and he is more effective, and learns more and does more good. And so try listening. Listen to your wife, your husband, your father, your mother, your children, your friends; to those who love you and those who don't, to those who bore you, to your enemies. It will work a small miracle. And perhaps a great one.

Marc Canter is on stage to announce the launch of StructuredBlogging.org, a non-profit initiative supporting the development and deployment of micro-formats in blog posts. The idea is pretty simple (but the implementation across all industry players is far from easy): as opposed to publishing a review of say, a movie, in a text format, a micro-format defines a number of fields that can be entered related to the movie: title, producer, director, actors, etc. Having information available in XML will make it much easier to intelligently extract elements of data to search, aggregate and syndicate. Specific plugins have been developed for WordPress and MovableType to make it easy to publish these formats through a blog. There are a couple of examples on the StructuredBlogging blog.

Today, December 12, Joe Agins Jr. was fired by store manager Julian Warner at starbucks on 2nd and 9th in NYC. Julian made reference to an alleged verbal argument that had occurred inside a starbucks outside of Joe's work time. Joe has been a member of the union since July and one of the hardest working and most committed organizers.

Today the United States Court of Appeals for the Third Circuit issued the most important decision affecting my client, Mumia Abu-Jamal, since the lower federal court ruling in December 2001. An order was issued this morning that the court will accept for review the following issues, all of which are of enormous constitutional significance and go to the very essence of Mumia's right to a fair trial due process of law, and equal protection of the law under the Fifth, Sixth and Fourteenth Amendments to the U.S. Constitution:

Claim 14: Whether appellant was denied his constitutional rights due to the prosecution’s trial summation.

Claim 16: Whether the Commonwealth’s use of peremptory challenges at trial violated appellant’s constitutional rights under Batson v. Kentucky, 476 U.S. 79 (1986).

Claim 29: Whether appellant was denied due process during post-conviction proceedings as a result of alleged judicial bias.

Claim 16 concerns the prosecutorial use of racism in jury selection. The record establishes beyond question that racism is a major thread that has run through this case since Mumia's 1981 arrest, and continues to today.

Claim 14 relates to the guilt phase. It includes the prosecutor's argument that if convicted Mumia would have "appeal after appeal." That comment effectively lessened the burden of the jurors, and turned the concept of reasonable doubt and presumption of innocence on its head.

Claim 29 is about the bias and incredible racism of Judge Albert Sabo, the trial judge. Unfortunately, it is limited to his conduct at the 1995 evidentiary (PCRA) hearing, rather than his monstrous behavior at trial. This restriction is because all of the prior attorneys mistakenly did not attack Sabo's misconduct at trial, an unfortunate oversight and mistake

The court has also issued a briefing schedule. The case is now on the fast track, as I have been predicting. The opening briefs are due to be filed by January 17, 2006.

If Americans buy American made products they will have fuller wallets to buy with. I also wonder aboutthe house bill the UAW is against. House Bill 2830 is causing a lot of commotion on Capitol Hill as well as a lot of stir from various unions. Many have not paid much attention to 2830, some think its another strain of the H5N1 bird flu, others think its just another tax bill they will be getting hit with. If you work in a unionized shop, or factory, you may want to dig a little deeper into the details of this bill that is going to the House of Representatives for approval, it could have a drastic affect on your livelihood.


The Pension Protection Act of 2005 (H.R.2830) is legislation that has resulted from Congress’s belief that the retirement security of American workers who are covered by defined benefit pension plans is seriously at risk. Congress feels that many of the pensions are under-funded because the pensions do not have enough money to pay all of the benefits they have promised. Congressmen have deferred to the recent United Airlines pension disaster as an example of the importance of this bill. Congress has also mentioned the Government Accountability Offices’ report that detailed the under-funding of the 100 largest defined benefit pension plans between 1995 and 2002.

As anyone who has read my ranting lately will attest, I’m highly upset about the Cory Maye case. Since the mainstream media has so far neglected to cover the story (and I’m aware of several members of the MSM who know about the story), it is critical for citizen journalists to pick up the slack. Because of the nature of the way this particular story is unraveling across the blogosphere, there are a lot of innacuracies floating around.

What I’d like to do is to begin a maintainable narrative of the case containing as much factual accuracy as possible. Using Radley Balko’s original account as a starting point, I’d like to do the edits required to place the Cory Maye story on Wikipedia.

They're asking us to cast votes for the grinch of the year.
